MPLX tells brokers to treat 100% of non-U.S. investor distributions as effectively connected income
MPLX issued a qualified notice to brokers and nominees holding units for non-U.S. investors under Treasury Regulation Section 1.1446-4(b) and (d) and Section 1.1446(f)-4(c)(2)(iii). Brokers and nominees must treat all of the partnership's distributions to non-U.S. investors as attributable to income effectively connected with a U.S. trade or business.
They must also treat 100% of the distribution as exceeding cumulative net income when determining the amount to withhold. As a result, distributions to non-U.S. investors are subject to federal income tax withholding at the highest applicable effective rate.
Nominees, not MPLX, are the withholding agents responsible for withholding on distributions they receive on behalf of non-U.S. investors.
